Moldovan cabinet approves amendments to labour legislation

Chisinau, 31 May /MOLDPRES/ – The Government approved at its meeting the amendment and completion of several articles of the Labour Code of the Republic of Moldova, today. They work to improve labour law and ensure respect for the legitimate rights and interests of both parties in their work reports, the government’s communication and protocol department has reported. 

However, there can be concluded the individual labour contract for a definite period of time for the fulfillment of the work obligations of the employee who is absent for unknown reasons, in order to improve the investment climate. Also, from the individual labour contract, it will be excluded the provisions of the collective labour contract and internal regulations of the unit regarding the employees’ working conditions. So, the employee will receive the collective labour contract, the internal regulation, as well as the information on the safety and health requirements.      

The labour code is completed with a new article regulating the stationary notion. This will represent the temporary impossibility of continuing the production activity by a unit, a group of employees or an employee. The remuneration of residence time, caused by reasons not dependent on the employer or the employee, shall be made in the amount of at least 2/3 of the basic salary per unit of time fixed to the employee, but not less than the amount of a minimum wage per unit time, for each stationary hour. In the case of stationary work caused by the employer's fault, that is obliged to compensate the employee's salary. At the same time, if the employee's fault occurs, it will not be paid for hours when he does not work.

The amendments also stipulate that the employer will be obliged to free the employee's salary certificate at the institution.

According to the project, technical unemployment during one calendar year will not exceed four months, and the monthly allowance will account for 50 per cent of the basic salary.

The approved amendments and additions bring the Labour Code of Moldova in line with the market economy’s modern requirements.
