Moldovan Democratic Party backs Justice Ministry's initiative on reform of control bodies

Chisinau, 10 October /MOLDPRES/ - The Democratic Party of Moldova (PDM) will support an initiative by the Justice Ministry on the reformation of the control bodies and decriminalization of the economic infringements. The PDM deputy leader, Sergiu Sarbu, today made statements to this effect at the end of the Democrats’ weekly meeting.     

According to Sarbu, the concept proposed by the Justice Ministry is inspired, to a great extent, from observations made by representatives of the business environment and investors. The legislative proposal is aimed at releasing the business environment from the pressure of the law-enforcement bodies and will provide extended powers to the control bodies.    

“Presently, we have more law-enforcement bodies with powers of control and powers in investigating economic offences. Many times, in practice, it happens that if there are infringements, a tax evasion for instance, which is a non-violent offence, searches are made, acts, equipment are raised and till the situation is cleared up, the economic agent suffers,” Sarbu said.      

The PDM deputy leader noted that the deprivation of freedom applied for economic offences is a too tough mechanism and economic agents should be given possibility to pay the damages caused to the state and only if they repeat the offence, they should be punished with imprisonment. “The new draft law stipulates that, in case of economic offences, emphasis should be put on the recovery of the damage, correction of mistakes and prevention of mistakes in the long run,” Sarbu added.    

Under the draft proposed by the Justice Ministry, an infringement could be considered criminal only after the mechanisms of remedying are exhausted or its level of seriousness poses an imminent risk to the public order, security and safety of people and the environment.    

The legislative initiative will be subjected to public consultations in the nearest time.
