Amendments to Moldova's labour code to be published in Official Journal

Chisinau, 19 October /MOLDPRES/ - The decree on the promulgation of the law on amendment and completion of the Labour Code, signed by President Igor Dodon, will be published in the 20 October issue of the Official Journal (Monitorul Oficial). The head of state has earlier rejected the document, following a discussion with trade unions’ representatives.

Under the document, 36 articles of the Labour Code will be changed and completed. The new regulations provide for the basic obligations of the wage earner to immediately inform the employer about impossibility to come to work, the effect of which will be turning the wage earners more responsible and disciplined. 

Another amendment stipulates that the holding by the employee of the status of age limit pensioner might be a reason for the employer to dismiss him/her. At the same time, these persons can be employed for a definite period.   

In the context, according to the new Labour Code, the employer will not be obliged to reason the decision on the unsatisfactory result of the test period and the dismissal of the wage earner trade union member will be made with the preliminary consultation of the unit’s trade union body. Another legislative amendment sees shortening of the additional unpaid child care leave by two years.     

At the same time, the Labour Code was completed with a new article, which defines the serious violation of the labour obligations. The article refers to the reception and issuance of assets and financial means, without the processing of the needed documents, use on of money, assets managed by the employer on personal purposes, refusal to make the medical examination, when it is compulsory, as well as causing a material damage which exceeds five average salaries on the economy.
