Moldova's Supreme Court of Justice rejects appeal filed by former prosecutor against evaluation commission's decision

The Supreme Court of Justice (CSJ) has rejected the appeal filed by former prosecutor Ion Tetcu against the decision of the Prosecutors' Evaluation Commission. The CSJ judges ruled that the evaluation had been conducted in accordance with the provisions of Law No. 26/2022 regarding measures related to selecting candidates for positions in the self-governing bodies of judges and prosecutors.

The Court said that, according to this law, the existence of serious doubts about a candidate's ethical or financial integrity is sufficient for them not to pass the evaluation.

“Even the smallest difference between income and expenditures over 15 years is enough to fail the evaluation provided by Law 26/2022,” reads the CSJ decision.

In the case of former prosecutor Ion Tetcu, the Commission identified a negative balance for the year 2021 between the income and expenditures of the candidate's family, amounting to 141,420 lei, a discrepancy confirmed by the CSJ as “supported by evidence, including bank documents and asset declarations.”

This is the eleventh appeal filed by a subject of Law 26/2022 and rejected by the Supreme Court of Justice. All 11 appeals submitted by candidates who did not pass the integrity evaluation under this law have been rejected by the CSJ, which upheld the Commission’s decisions.
