Maternity allowances can be recalculated in Moldova

Chisinau, 06 June /MOLDPRES/ – The maternity allowances may be recalculated if mistakes occurred at their determination, according to a decision announced by the Constitutional Court of Moldova (CCM) today.

The CCM’s press service has informed that a referral to the matter was submitted in March 2017 by the applicant’s lawyer, who is in trial with the National Social Insurance House.

The Court found that it was claimed that the incomes were not included in the basis of calculating the maternity allowance of the person and that the competent authority refused to correct the amount of the indemnity set, referring to the fact that recalculation is forbidden if the allowances had been priorly established.

However, the CCM has determined that the offended person has the right to the claimed right’s recognition, the act annulment and repair of the damage.

The CCM’s decision is final, can not be subject to any appeal, enters into force on the date of its adoption and is published in the Official Journal of the Republic of Moldova.
