
Moldovan MPs adopt draft transposing provisions of Istanbul Convention into legislation
Chisinau, 10 March /MOLDPRES/ - The emergency restriction order, through which protection measures are enforced for removing the aggressor from the family’s dwelling, might provide safety to the victim and the family members, both in their dwelling and outside it. The parliament today adopted a draft law, in the first reading, meant to transpose the provisions of the Istanbul Convention into the national legislation.
The emergency restriction order is an administrative act issued by the police, through which protection measures are enforced, meant to ensure immediate removing of the aggressor from the family’s dwelling and establishing interdictions seen by the law, in order to prevent the repeating/committing of the violent actions, thus providing to the victim and other family members safety in their dwelling and outside it.
Under the draft, the new stipulations define the notion of violence against women as any gender-based violence action, which causes or may cause physical, sexual or psychological suffering to women, including threatening with these actions, arbitrary forcing or depriving of freedom, committed in the public or private sphere.
Another amendment sets that decision-makers and professionals, who are imposed to ensure confidentiality, are obliged to report to the competent authorities about the acts of domestic violence which endanger the life or health of the victim or about the imminent danger of the occurring of such violence acts. In the other cases, the reporting will be made only with the victim’s agreement.
