
Maintenance pension cannot be lower than 50% of subsistence minimum
The maintenance pension, including for children will be updated by setting up a reevaluation mechanism. The promulgation decree and the law amending the Family Code have been published in today's Official Journal.
The document establishes a reevaluation mechanism of the maintenance pension set at a fixed amount, which cannot be lower than 50% of the minimum existential level calculated by the National Statistics Bureau (BNS).
The act provides that all maintenance pensions set at a fixed monetary amount by the court will keep pace with the fluctuation of the annual average national value of the minimum existential level, published and updated annually by the BNS.
The law also provides that the court decision establishing the maintenance pension amount constitutes an enforceable title. If the debtor does not make the payment in the established amount, the creditor can request enforced execution from the judicial executor in the territorial area where the debtor resides.
According to data presented by the BNS, in the last five years, the minimum existential level for children has increased by 46.5%.
The law comes into force one month after its publication in the Official Journal of the Republic of Moldova.
