Venice Commission says draft law on Constitutional Court observes international standards

The Venice Commission has found out that the draft law on the Constitutional Court (CC) of Moldova was aligned with the international standards and observed the constitutional principles and the best practices. The conclusion was adopted at the 142nd plenary session.

At the same session, the Commission formulated more recommendations for the improvement of the draft law, among which the clearing up of the regime of disciplinary sanctions for the CC judges, verification of the constitutionality of the international treaties and details on the process of appointment and taking oath by magistrates.

Attending the plenary session, Justice Minister Veronica Mihailov-Moraru thanked the Commission members for the expertise provided and discussed aspects on the control of the constitutionality of international treaties, the entrance into force of the Court’s rulings and the decision-making process in the case of votes’ parity.

The draft law, the goal of which is merger of the two present normative acts on the Constitutional Court into a single legal framework, was adopted by the parliament in the first reading in December 2024. The draft is to be adjusted according to the recommendations by the Venice Commission before the final adoption.
